Moss Terms of Use

These Terms of Use ("Terms") govern your access to and use of Moss (the "App"), provided by Virtual World LLC ("Virtual World", "we", "us", or "our"). By downloading, accessing, or using Moss, you agree to these Terms.

If you do not agree, do not use Moss.

Moss is an iPhone screen-time wellness app. You choose the apps that distract you and Moss shields them using Apple's Screen Time technology. Physical movement, such as walking, earns minutes. Spending minutes opens a temporary window in which your chosen apps are available, and the shield returns when the window ends.

Your balance, history, settings, and any photos you add are stored on your device.

Moss uses Apple's Family Controls, Managed Settings, and Device Activity technology, with your permission, to shield apps on your own device. This is a self-control tool that you configure and can change at any time. You can remove the shield by changing your selection in the App, deleting your data, or revoking Screen Time access in iOS Settings.

Moss is intended for your own device only. It is not a parental control service and must not be used to restrict another person's device without their knowledge and consent.

Shielding depends on Apple's Screen Time system and may be affected by iOS behavior outside our control. Do not rely on Moss as your only safeguard for access to critical apps or communications.

With your permission, Moss reads step and wheelchair push counts from Apple Health to convert movement into minutes. Moss never writes to Apple Health and never uploads your health data.

Moss is not a medical device, medical service, diagnostic tool, or fitness advisor. Minute counts, trends, and any wellness content are for general informational and motivational purposes only. Always consult a qualified healthcare professional before making medical or exercise decisions.

You must be at least 13 years old to use Moss. If you are under the age of majority where you live, you may use Moss only with permission from a parent or legal guardian.

Moss does not require sign-up or sign-in. The App may use an anonymous app user identifier to manage subscriptions and restore purchases.

You are responsible for your device, App Store account, and any activity that occurs through your copy of the App.

Some Moss features require Moss Undergrowth, an auto-renewable subscription available in monthly and yearly plans.

Subscriptions are billed through Apple In-App Purchase. Prices, subscription periods, trials, and renewal terms are shown in the App before purchase and may vary by region.

Unless cancelled, subscriptions automatically renew through your Apple Account. You can manage or cancel subscriptions in your Apple Account subscription settings, or from the Manage Subscription control inside the App. Cancellation takes effect at the end of the current billing period unless Apple states otherwise.

Apple handles payment processing, billing, refunds, and payment-method information. We do not receive your full payment card details. Refund requests are handled according to Apple's policies.

Moss uses RevenueCat to validate purchases, subscription status, and entitlement access.

Photos you add are stored only in Moss's private storage on your device. They are never uploaded to a server, posted, or shared by the App, and we never see them. You retain full ownership of your content, and you are responsible for anything you choose to share yourself, for example through the iOS share sheet.

You agree not to:

• Use Moss for medical diagnosis, treatment, emergency decisions, or clinical decision-making.
• Use Moss to restrict or monitor another person's device without their knowledge and consent.
• Reverse engineer, decompile, tamper with, or attempt to extract source code, keys, or stored data.
• Bypass subscriptions, access controls, or security protections.
• Interfere with the App, our service providers, or other users.
• Use Moss in violation of applicable law or third-party rights.

We may limit, suspend, or terminate access if we believe these Terms are being violated or if use creates legal, security, fraud, cost, or operational risk.

Your use of Moss is also governed by our Privacy Policy. It explains how Moss keeps your health data, app selection, and activity on your device, and how subscriptions, anonymous app identifiers, and deletion work.

Moss, including its design, software, text, visual elements, product experience, branding, trademarks, and other content, is owned by Virtual World LLC or its licensors and is protected by law.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Moss for your own personal, non-commercial use on Apple-branded devices you own or control, as permitted by Apple's App Store rules.

Moss relies on third-party services, including Apple and RevenueCat. Those services may be subject to their own terms and policies. We are not responsible for third-party services outside our control.

If you downloaded Moss from the Apple App Store, your use of Moss is also subject to Apple's applicable App Store terms, including the Apple Media Services Terms and Conditions and Apple's standard Licensed Application End User License Agreement unless a separate custom EULA applies.

Apple is not responsible for providing maintenance or support for Moss. To the extent required by Apple's terms, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

MOSS IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AVAILABILITY, NON-INFRINGEMENT, AND RELIABILITY.

We do not guarantee that Moss will be uninterrupted, secure, error-free, accurate, or available at all times. We do not guarantee that any app will be shielded at any given moment, and we do not guarantee any health, wellness, productivity, or screen-time outcome.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRTUAL WORLD LLC AND ITS OWNERS, EMPLOYEES, CONTRACTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, PERSONAL INJURY, MISSED COMMUNICATIONS, OR HEALTH-RELATED DECISIONS ARISING FROM OR RELATED TO YOUR USE OF MOSS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO MOSS OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO USE MOSS IN THE THREE MONTHS BEFORE THE CLAIM AROSE OR USD $50.

You agree to defend, indemnify, and hold harmless Virtual World LLC and its owners, employees, contractors, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of Moss, your content, your violation of these Terms, or your violation of law or third-party rights.

You may stop using Moss at any time. We may suspend or terminate access to Moss or specific features if we believe you violated these Terms, created risk, misused the service, or if we discontinue Moss.

Termination does not automatically cancel your Apple subscription. You must cancel subscriptions through your Apple Account subscription settings.

We may update Moss, change features, change subscription offerings, add or remove functionality, or discontinue parts of the App. We may update these Terms from time to time. If changes are material, we will provide notice where required. Continued use after changes means you accept the updated Terms.

These Terms are governed by the laws applicable to Virtual World LLC in its place of organization, excluding conflict-of-law rules, unless local law requires otherwise.
